Agreement to Terms

By accessing or using the PickleTool mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and House of Holder, LLC d/b/a PickleTool.

Eligibility

You must be at least 13 years old to use PickleTool. By using the App, you represent that:

You are at least 13 years of age
You have legal capacity to enter into these Terms
You will comply with these Terms and all applicable laws

User Conduct

You Agree NOT To:

Violate any laws or regulations
Harass, abuse, or threaten other users
Impersonate any person or entity
Post false or misleading content
Interfere with or disrupt the App
Create multiple accounts to manipulate ratings
Spam other users with unwanted messages

SMS/Text Messaging Terms

Program Description

PickleTool offers optional SMS notifications for:

Match notifications and reminders
Event updates and confirmations
Challenge invitations
Account notifications
Game confirmations

Opt-In Consent

By providing your phone number and opting in:

You consent to receive recurring automated promotional and transactional text messages
You certify you are the account holder or have authorization
Consent is NOT required to use PickleTool services
Message frequency varies based on your activity
Message and data rates may apply

How to Opt-In

Check the SMS opt-in box during registration
Enable SMS in your App settings
Text START when prompted

How to Opt-Out

You can opt out at any time:

Text STOP to any message from PickleTool
Disable SMS in your App settings
Contact support@pickletool.com

After sending STOP, you'll receive one confirmation message that no further messages will be sent.

Message Frequency

Message frequency varies based on your activity and preferences. You may receive up to 10 messages per week during active periods.

Supported Carriers

PickleTool SMS is supported on major U.S. carriers including AT&T, T-Mobile, Verizon, Sprint, and others. Availability may vary.

Mobile Information Privacy

We do NOT share your mobile phone number or SMS opt-in data with third parties or affiliates for marketing purposes.

Subscriptions and Payments

Subscription Plans

Premium features require a paid subscription
Subscriptions are billed through Apple App Store or Google Play Store
Prices are subject to change with notice

Auto-Renewal

Subscriptions automatically renew unless canceled
Cancel anytime in your device's subscription settings
Cancellation takes effect at end of current billing period

Location Services

The App uses location data to find nearby courts and players
You can disable location in device settings
Some features require location access to function

The App integrates with third-party services:

Clerk: Authentication
Convex: Database services
Google Maps: Location and mapping
Stripe: Payment processing
Twilio: SMS message delivery
DUPR: Official pickleball ratings

NO WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Use at Your Own Risk

We do not guarantee user identity, skill level, or conduct
Exercise caution when meeting users in person
Verify court availability before visiting

Physical Activity

Pickleball involves physical activity and risk of injury
Consult a physician before engaging in physical activity
We are not liable for injuries sustained while playing

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICKLETOOL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO PICKLETOOL IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY, OR $100, WHICHEVER IS GREATER.

Account Termination

Termination by You

You may delete your account at any time through App settings.

Termination by Us

We may suspend or terminate your account if:

You violate these Terms
You engage in fraudulent or illegal activity
We are required to do so by law

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes. Your continued use after changes constitutes acceptance of the updated Terms.
