Agreement to Terms

By accessing or using the PickleTool mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and House of Holder, LLC d/b/a PickleTool.

Eligibility

You must be at least 13 years old to use PickleTool. By using the App, you represent that:

• You are at least 13 years of age
• You have legal capacity to enter into these Terms
• You will comply with these Terms and all applicable laws

User Conduct

You Agree NOT To:

• Violate any laws or regulations
• Harass, abuse, or threaten other users
• Impersonate any person or entity
• Post false or misleading content
• Interfere with or disrupt the App
• Create multiple accounts to manipulate ratings
• Spam other users with unwanted messages

Subscriptions and Payments

Subscription Plans

• Premium features require a paid subscription
• Subscriptions are billed through Apple App Store or Google Play Store
• Prices are subject to change with notice

Auto-Renewal

• Subscriptions automatically renew unless canceled
• Cancel anytime in your device's subscription settings
• Cancellation takes effect at end of current billing period

Location Services

• The App uses location data to find nearby courts and players
• You can disable location in device settings
• Some features require location access to function

Third-Party Services

The App integrates with third-party services:

• Clerk: Authentication
• Convex: Database services
• Google Maps: Location and mapping
• Stripe: Payment processing
• Twilio: SMS message delivery
• DUPR: Official pickleball ratings

Your use of these services is subject to their respective terms and privacy policies.

How We Use Your Data, Including for AI

Your Content. You keep ownership of the information and files you add to PickleTool ("Your Content"). You give House of Holder, LLC a non-exclusive, worldwide, royalty-free license to host, process and display Your Content to run, secure and improve PickleTool for you.

De-identified Data and AI. House of Holder, LLC may create de-identified and aggregated data from Your Content and your use of PickleTool, combined with data from other users, so that it can no longer reasonably be linked to you or your household ("De-identified Data"). We may use De-identified Data, and may use Your Content internally, to develop, train and improve analytics, benchmarks and artificial-intelligence features. House of Holder, LLC owns De-identified Data and may use and share it for any lawful purpose, including in reports and data products for third parties. We will not try to re-identify De-identified Data, and we contractually prohibit recipients from doing so.

What We Don't Do. We do not sell your personal information, and we do not share information that identifies you with third parties for their own marketing. Our Privacy Policy explains your rights and choices, including how to opt out of having Your Content used to train AI features.

• We do not guarantee user identity, skill level, or conduct
• Exercise caution when meeting users in person
• Verify court availability before visiting

Physical Activity

• Pickleball involves physical activity and risk of injury
• Consult a physician before engaging in physical activity
• We are not liable for injuries sustained while playing

Limitation of Liability

Account Termination

Termination by You

You may delete your account at any time through App settings.

Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• We are required to do so by law

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes. Your continued use after changes constitutes acceptance of the updated Terms.
